Terms of Service

I. Scope

  1. The terms and conditions apply to contracts for the temporary letting of rooms for accommodation as well as all other services and deliveries of the hotel (hotel accommodation contract) provided in this connection for the customer. The term "hotel accommodation contract" includes and replaces the following terms: accommodation, guest reception, hotel and hotel room contract.

  2. The subletting or re-letting of the rooms or beds provided and their use for a purpose other than accommodation, requires the prior written consent of QBE Mobile Hotels GmbH - hereinafter referred to as QBE Mobile Hotels - according to §540 para. 1 sentence 2 BGB, if the guest is not a consumer.

  3. General terms and conditions of the customer only apply if this has previously been expressly agreed in writing.

II. Conclusion of the contract, partners; limitation

  1. The contract is concluded by the acceptance of the customer's request by the hotel. QBE Mobile Hotels is free to confirm consent in writing.

  2. Contractual partners are the hotel and the customer. If a third party has ordered for the customer, he is jointly and severally liable to QBE Mobile Hotels together with the customer for all obligations arising from the hotel accommodation contract.

  3. All claims against QBE Mobile Hotels expire in principle one year from the beginning of the knowledge-dependent regular limitation period of § 199 para. 1 BGB.

III. Services, prices, payment, offsetting

  1. QBE Mobile Hotels is obliged to keep the rooms reserved by the customer available and to provide the agreed services.

  2. The customer is obliged to pay the applicable or agreed hotel prices for the room rental and the other services used by him. This also applies to services provided by the customer and expenses of the hotel to third parties.

  3. The agreed prices include the respective statutory value added tax. If the period between conclusion of the contract and performance of the contract exceeds four months, and the price regularly invoiced by QBE Mobile Hotels for the agreed services on the other hand, the contractually agreed price may be increased appropriately, but not more than 5% unilaterally by QBE Mobile Hotels.

  4. Prices may also be changed by the hotel if the customer subsequently requests changes to the number of rooms reserved, the hotel's service, the number of guests or the length of stay of the guests, and the hotel agrees.

  5. The provisional final price for the night is payable at check-in. Invoices of the hotel without a due date are payable within 10 days from receipt of the invoice without deduction. The hotel is entitled to make any accrued claims due at any time and to demand immediate payment. In the event of late payment, the hotel is entitled to demand the applicable statutory default interest of currently 8% or, in the case of legal transactions in which a consumer is involved, in the amount of 5% above the base interest rate. The hotel reserves the right to prove higher damages.

  6. QBE Mobile Hotels is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter, taking into account the legal provisions applicable to package holidays. The amount of the advance payment and the payment dates can be agreed in writing in the contract. Furthermore, a deposit may be required upon arrival.

  7. The guest can only set off against a claim of QBE Mobile Hotels with an undisputed or legally enforceable claim.

  8. A resignation of the customer from the contract concluded with the hotel requires the written consent of the hotel. If this is not the case, the agreed price from the contract must be paid even if the customer does not make use of contractual services.

  9. Insofar as an appointment for a free cancellation of the contract has been agreed in writing between the hotel and the customer, the customer can by then withdraw from the contract without thereby triggering any payment or damage claims of the hotel. Unless otherwise specified, a free cancellation can be declared until 72 hours before the agreed check-in. The customer's right of withdrawal lapses if he does not exercise his right of withdrawal in writing vis-à-vis the hotel by the agreed date, unless a case of the customer's resignation pursuant to para. 1 sentence 3 exists. Changes or other changes to the booking must be clarified with the hotel in advance. Here, a processing fee can be charged.

  10. In case of late cancellation or non-arrival on the day of arrival, the hotel is free to charge the full amount.

  11. If the key is lost, 40 € will be charged per key. In the case of unauthorized smoking in the room or in the enclosed facilities such as shower and washrooms or the common room up to 250 € penalty will be charged and QBE Mobile Hotels reserves the right to take further legal action. This also applies to the damage to the equipment and facilities of the hotel - the penalty depends on the amount of damage.

IV. Cancellation by QBE Mobile Hotels

  1. If an agreed advance payment or an advance payment required by clause III no. 6 is not made even after expiry of a reasonable period of grace set by the hotel, QBE Mobile Hotels shall be entitled to withdraw from the contract.

  2. Furthermore, QBE Mobile Hotels is entitled to extraordinary cancellation of the contract for justifiable cause, for example if

  • force majeure or other circumstances for which QBE Mobile Hotels is not responsible make performance of the contract impossible;

  • the reservation has been made under misleading or false statement of material facts, eg in the person of the guest or the purpose;

  • QBE Mobile Hotels has reason to believe that the use of the services of QBE Mobile Hotels may endanger the smooth operation, security or reputation of QBE Mobile Hotels in public;

  • In case of a justified cancellation of QBE Mobile Hotels no claim of the guest for damages arises.

V. Room and bed supply

  1. The guest is not entitled to the provision of certain rooms.

  2. Check-in times are from 2pm to 6pm. In case you would like to arrive earlier or later, we kindly ask you to inform us in time and to guarantee the reservation with a credit card number. For guaranteed bookings with a valid credit card, arrivals are possible until 8 pm. Otherwise, the rooms can be canceled and resold. Cancellations are possible until 72h before arrival.

    Check-out is until 11 am on the day of departure.

  3. If the guest does not vacate the room on the day of departure by no later than noon, QBE Mobile Hotels will charge 50% of the current daily rate, if the excess does not last longer than 2 pm. From 2 pm on 100% of the current daily rate will be charged. For a late check-in, 15 € will be charged per commenced hour, if QBE Mobile Hotels decides to receive guests after the check-in times.

  4. Pets are required to be registered with the reservation and require special permission from QBE Mobile Hotels. There is a separate charge of 10 euros per day per animal. The fee may vary depending on the size of the pet.

VI. Liability of QBE Mobile Hotels GmbH

  1. QBE Mobile Hotels is liable for damages resulting from culpable injury to life or health; for damages that are based on an intentional or grossly negligent breach of duty or the culpable violation of contractual obligations. Further liability is excluded.

  2. For items brought in, QBE Mobile Hotels is liable according to the legal regulations limited to one hundred times the room or bed price, but not exceeding the amount of five hundred euros. The liability claims expire if the guest does not notify QBE Mobile Hotels immediately after becoming aware of the damage.

  3. If the guest is provided with a parking space free of charge or against payment, this does not constitute a custody agreement. QBE Mobile Hotels is not liable for loss of or damage to parked or parked vehicles or their contents.

VII. Privacy Policy

QBE Mobile Hotels GmbH respects the confidentiality of the personal information of its guests. Personal information will not be disclosed to third parties without the guest's consent, unless legal requirements require the data to be transmitted. All other details are in the Privacy Policy

VIII. Correspondence

With the completion of your booking the guest accepts the receipt

  • of an e-mail containing reservation information, which will be sent to the guest shortly after the booking has been completed

In addition to emails received by the guest for booking confirmation, modification or cancellation, as well as any communication from the hotel regarding bookings and e-mails received upon express request, no further messages, e-mails or letters will be sent. Unless the guest expressly agrees otherwise.

IX. Final Provisions

  1. Place of performance and place of payment is the registered office of QBE Mobile Hotels GmbH.

  2. German law applies.

  3. Exclusive jurisdiction is Berlin, Germany.

  4. Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions.
